Eight years after the adoption of Directive 2014/42/EU on the freezing and confiscation of instrumentalities and proceeds of crime in the EU, the expected results have not been achieved and serious shortcomings have been identified that need to be overcome. For this reason, on 25 May 2022, the EU institutions presented the Proposal for a Directive of the European Parliament and of the Council on the recovery and confiscation of assets, which represents a profound transformation of the institution and in turn constitutes a new opportunity for the national legislator to adapt and reform domestic legislation, overcoming the shortcomings and excesses that occurred with the first transposition. |
