Summary: The objective of this scientific paper is to analyze the social protection of ethnic group´s health within the framework of law “100” of 1993 and law “691” of 2001. The methodology focuses on a hermeneutic documentary type qualitative approach, applying the technique of documentary analysis, using observation and bibliographic review as instruments for data collection. Among results, the following stands out: the administrative-technical overdesign of Colombia’s health system acts as a hurdle for the effective care and access to social protection for the health of ethnic groups; likewise, poor health care coverage that ignores ancient traditions and the social and cultural characteristics of these ethnic environments. This paper originality and contributions are centered on the socio-legal approach to public law and to ethnic group´s social security, taking into account sociodemographic and physiological conditions, as well as, health determinants. In conclusion, it is pertinent to highlight the existing tension when applying, by constitutional and legal mandate within the model of Social State of Law, Colombia’s ethnic special protection regime, which considers geographic, sociocultural, political, financial, health, administrative factors and the little to no intervention by the state to enforce the already established mandatory ethnic health plans. Finally, it is important and necessary to point out the need to carry out reforms to the mandatory health plan taking biopsychosocial diversity of ethnic groups into account.
