Despite the consequences of its absence or illegality at the operational level, uncertainty dominates the issue at three levels: during the applications for authorisation to build and operate the project, during the assessment of its conditions for obtaining authorisation and, finally, during its contentious treatment. This study therefore aims to provide an overview of the current situation, amidst uncertainties and attempts at clarification.La exención para las especies y los hábitats protegidos, que permite combinar el objetivo de conservar la biodiversidad con el desarrollo de instalaciones de energía renovable, está ahora más que nunca en el centro del proceso de autorización de proyectos. A pesar de las consecuencias de su ausencia o ilegalidad en el plano operativo, la incertidumbre domina el asunto en tres niveles: durante las solicitudes de autorización para construir y explotar el proyecto, durante la evaluación de sus condiciones para obtener la autorización y, por último, durante su tratamiento contencioso.
