Summary: The exemption for protected species and habitats, which allows combining the objective of conserving biodiversity with the development of renewable energy installations, is now more than ever at the heart of the project authorisation process. Despite the consequences of its absence or illegality at the operational level, uncertainty dominates the issue at three levels: during the applications for authorisation to build and operate the project, during the assessment of its conditions for obtaining authorisation and, finally, during its contentious treatment. This study therefore aims to provide an overview of the current situation, amidst uncertainties and attempts at clarification.
