Summary: |
Contrary to popular belief, ecological compensation has existed in the French legal system for some forty years. However, it is particularly since 2016 that it has
been increasingly concretised, at the same time as an effective normative consecration. By imposing an obligation to achieve results, within the «Avoid, Reduce, and Compensate» sequence, the law intends to create a «compensation offer», in particular through the creation of natural compensation sites. Nevertheless, despite all these advances and the numerous legislative and regulatory provisions devoted to the notion of compensation and its implementation methods, many questions remain. |
