O Tribunal Superior Eleitoral, em 2006, decidiu que esta situação não é inconstitucional e não é incompatível com a imparcialidade devido à premissa do caráter único da justiça eleitoral. Portanto, este artigo discorda com este posicionamento, seguindo o posicionamento da Constituição Federal de 1988 e seus princípios, como o do devido processo legal, e objetiva ajudar a sociedade a alcançar um processo mais imparcial e justo.PALAVRAS-CHAVE: Competências da Justiça Eleitoral. Princípio Constitucional da Imparcialidade do juiz.ABSTRACTThis article analyzes the constitutionality of the judgement realized by the same judges who investigated the electoral crimes. This investigation power was given to the electoral judges in the Electoral Code, Law nº 4.737/65, which lists the electoral competencies. The Superior Electoral Court of the Brazil in 2006 decided that this situation is not unconstitutional and is not incompatible with impartiality because of the unique character of the Electoral Judiciary. Therefore, this article disagrees with this position according to the Federal Constitution and its principles, e.g. due process of law, and wants to help our society to reach a process more impartial and closer from the justice.Keywords: Powers of the Electoral Judiciary.
