Summary: The present study deals, based on Bioethics, Human Rights and Constitutional Rights, the theory of civil capacity and its relationship with autonomy and self-determination, from the perspective of the CRPD and the EPD. The method is qualitative, of content analysis, in scientific articles - originated from Philosophy, Psychology and Psychiatry - texts of legal doctrine and pertinent national and international legislation. In conclusion, legal systems that expose the disabled person to too many risks or may affect their entirety should provide for safeguards in accordance with Human Rights and Constitutional Rights.
