The objective of the research is to demonstrate, through interdisciplinarity, the fragility of theories of judicial decision that support the hypothesis that it is possible to find normatively correct answers in judicial decisions.O estudo que segue, inserido no campo de pesquisa atinente às teorias da decisão judicial, busca refletir, a partir de breve revisão bibliográfica, sobre a potência performática da linguagem judicial a partir das narrativas produzidas na jurisdição. Para tanto, recuperam-se preceitos da filosofia sofista como a persuasão e a retórica, que vão associados aos aspectos narrativos da decisão judicial.
