It is argued that silence or elusive responses during the written test phase do not necessarily affect the right of defense or contradict the principle of non-selfincrimination, as well as that such an attitude may be justified at a certain moment.Se analiza la incidencia de la ficta confessio o confesión presunta en el marco de aplicación del art. 72 de la L. 834-78 y su no conflictividad, respecto del procedimiento civil ni con el principio constitucional de no autoincriminación, ni con la noción del debido proceso.
