It is a regulation that comes from RD-Ley 5/2013 and that has already undergone some important modifications and that has once again been affected by the Social Security reform of 2021. This article analyzes the development of the aforementioned regulation, through its motivations and the case-law that has applied it. Special attention is paid to the perspective expressed on it in the Report on the Evaluation and Reform of the Pacto de Toledo and the Agreement between the social parties and the Government of 2021 and, above all, to the reforms derived from both instruments. The conclusion reached is basically that there is no defined model in the Spanish Social Security system on the compatibility between the provision of subordinate or autonomous work and the receipt of a retirement pension. It is true that the programmatic documents are in favor of facilitating it, but without more or less clear conditions and limits having been consolidated.En el sistema español de Seguridad Social, la expresión “envejecimiento activo” se ha vinculado con una concreta regla de compatibilidad del trabajo con el disfrute de la pensión de jubilación. Se trata de una regulación que procede del RD-Ley 5/2013 y que ha sufrido ya algunas importantes modificaciones y que ha vuelto a ser afectada por la reforma de Seguridad Social de 2021. En este artículo se analiza el desarrollo de la referida normativa, a través de sus motivaciones y de la doctrina judicial que la ha aplicado. Se presta especial atención a la perspectiva que sobre ella expresan el informe de Evaluación y Reforma del Pacto de Toledo y el Acuerdo entre las partes sociales y el Gobierno de 2021 y, sobre todo, a las reformas derivadas de ambos instrumentos. La conclusión que se alcanza consiste básicamente en que no existe en el sistema español de Seguridad Social un modelo definido sobre la compatibilidad entre la prestación de un trabajo por cuenta propia o ajena y la percepción de la pensión de jubilación.
