Summary: In the Spanish Social Security system, the expression “active aging” has been linked to a specific rule of compatibility of work with the enjoyment of the retirement pension. It is a regulation that comes from RD-Ley 5/2013 and that has already undergone some important modifications and that has once again been affected by the Social Security reform of 2021. This article analyzes the development of the aforementioned regulation, through its motivations and the case-law that has applied it. Special attention is paid to the perspective expressed on it in the Report on the Evaluation and Reform of the Pacto de Toledo and the Agreement between the social parties and the Government of 2021 and, above all, to the reforms derived from both instruments. The conclusion reached is basically that there is no defined model in the Spanish Social Security system on the compatibility between the provision of subordinate or autonomous work and the receipt of a retirement pension. It is true that the programmatic documents are in favor of facilitating it, but without more or less clear conditions and limits having been consolidated.
