The article makes a brief overview of the relationship between human rights and democracy, and how the Inter- American Democratic Charter has a fundamental role in the protection of human rights, especially judicial independence, freedom of expression, and political rights. Finally, the reasons why the Inter-American Court thought that in international human rights law there is no autonomous right to indefinite presidential re-election are developed and how the restriction of political rights in terms of this aspect is compatible with the American Convention on Human Rights.La opinión consultiva n.º 28 adoptada por la Corte Interamericana de Derechos Humanos constituyó la primera ocasión en la que un tribunal internacional de derechos humanos se pronuncia sobre la figura de la «reelección presidencial indefinida». El artículo hace un breve recorrido sobre el vínculo entre los derechos humanos y la democracia, y cómo la Carta Democrática Interamericana tiene un papel fundamental al momento de la protección de derechos y libertades fundamentales, especialmente referidos a la independencia judicial, la libertad de expresión y los derechos políticos.
