The advisory opinion No. 28 adopted by the Inter-American Court of Human Rights constituted the first occasion in which an international court of human rights rule on the figure of «indefinite presidential re-election». The article makes a brief overview of the relationship between human rights and democracy, and how the Inter- American Democratic Charter has a fundamental role in the protection of human rights, especially judicial independence, freedom of expression, and political rights. Finally, the reasons why the Inter-American Court thought that in international human rights law there is no autonomous right to indefinite presidential re-election are developed and how the restriction of political rights in terms of this aspect is compatible with the American Convention on Human Rights. |
