Summary: Information and communication technologies allow you to work anywhere, anytime, blurring the line between working hours and personal life, and in many cases helping to extend working hours. There is an intrusion of work into private life, confusion between place and time of work and private life and privacy of the worker and results in an increase in the power of control of the employer through the use of ICTs, to the detriment –or even violation– of the rights to the dignity and privacy of workers. The regulation of the right to disconnection is directly connected with the power of control and direction of the employer, the exercise of which takes place within the working day that marks the limit of those powers, and must ensure that they cannot be extended to a non-working time (outside the working day). A new interpretation is imposed updated and accommodating to the new reality of traditional business powers within the framework of industrial relations where new digital technologies that have altered the game of forces of the parties to the employment contract.
