Expansion that requires at the same time to safeguard its true essence, especially when what is appropriate to resolve a conflict is the recognition of new rights so as not to contaminate its notion. It reviews an evolution that, starting from a fundamentally individualistic dimension and of necessary comparison of situations, has moved towards truly objective analyses, aimed at groups and collectivities, in which the reparative mechanism (positive discrimination actions), the diagnosis of the situation (indirect discrimination) and the prohibited factors, such as age, disability and religious freedom, are expanded, as directly related to employment.El estudio reflexiona sobre la evolución experimentada por el concepto de discriminación y su específica técnica de tutela, que ha ido ampliando de forma paulatina su ámbito objetivo de actuación con el refrendo de los principales Tribunales nacionales e internacionales. Expansión que requiere al mismo tiempo salvaguardar su verdadera esencia, sobre todo cuando lo que procede para resolver un conflicto es el reconocimiento de nuevos derechos a fin de no contaminar su noción.
