The study reflects on the evolution experienced by the concept of discrimination and its specific
technique of protection, which has gradually expanded its objective scope of action with the
endorsement of the main national and international Courts. Expansion that requires at the same
time to safeguard its true essence, especially when what is appropriate to resolve a conflict is the
recognition of new rights so as not to contaminate its notion.
It reviews an evolution that, starting from a fundamentally individualistic dimension and
of necessary comparison of situations, has moved towards truly objective analyses, aimed at
groups and collectivities, in which the reparative mechanism (positive discrimination actions),
the diagnosis of the situation (indirect discrimination) and the prohibited factors, such as age,
disability and religious freedom, are expanded, as directly related to employment. |
