Summary: This paper analyzes the legal delimitation of the employment test before the development of the work provided through digital platforms. The reader will have access to the interpretation of the concept of subordination, understood in a flexible and expansive way, regarding its application to the labor organization system of digital platform companies. Likewise, the essential ideas related to the contrast of the work model in digital platform companies are developed. This is analyzed according to the employment test interpreted by the Spanish Supreme Court. This jurisprudence protectively assimilates employees, as it is understood that they are part of the governing and organizational circle of their employers.
