After that, we intend to understand how Law can mitigate its effects on society. The research problem is the reconfiguration of types of racism on the Brazilian society since the creation of the anti-discrimination law and if the Brazilian legal order is prepared to face it. Then, we distinguish the crimes of Insult and Racism according to the national law, also approaching the Prejudice Insult aggravation and its consequences at the moment of adjudication. Finally, we identified that racism, regardless the way it is manifested, has consequences that must be put away from its victims, and Law must protect everyone in order to preserve their dignity.O artigo tem por objetivo compreender como a discriminação pela raça se modificou após o ingresso da Lei nº 7.716, de 5 de janeiro de 1989, no ordenamento brasileiro, e a partir disso entender como o Direito deve atuar para mitigar seus efeitos na sociedade. O problema de pesquisa é que há, a partir da lei antirracismo, uma reconfiguração das formas de racismo na sociedade brasileira, e se o ordenamento brasileiro está preparado para enfrentá-lo. Dentro disso, partimos para a análise da distinção dos crimes de injúria e racismo segundo a legislação nacional, abordando ainda o agravante da injúria preconceituosa e suas consequências no momento da formulação das decisões dos magistrados.
