This article aims to discuss how race discrimination has been modified since Law No. 7,716 was enforced on January 5th, 1989 into the Brazilian legal order. After that, we intend to understand how Law can mitigate its effects on society. The research problem is the reconfiguration of types of racism on the Brazilian society since the creation of the anti-discrimination law and if the Brazilian legal order is prepared to face it. Then, we distinguish the crimes of Insult and Racism according to the national law, also approaching the Prejudice Insult aggravation and its consequences at the moment of adjudication. Finally, we identified that racism, regardless the way it is manifested, has consequences that must be put away from its victims, and Law must protect everyone in order to preserve their dignity. |
