This paper presents an analysis of the situation from an economic and legal perspective, under the Spanish legal system, intending to highlight the specificities of the sector, on the one hand, and, on the other hand, due to the necessity of counting of those peculiarities’ treatment and regulation. The methodology is based on the main postulates of economic analysis and the Spanish ports regulatory framework. It is intended to facilitate the understanding of the multiple factors that come together in this sector, whose conjunction and simultaneous consideration is necessary to design action and policy proposals. Doing that, it will favour the productivity, efficiency and profitability of each port as well as of the whole system. Moreover, it will come on an improvement of the socio-economic situation of the workersEl papel de la estiba ha sido tan esencial como controvertido en el contexto de los sistemas portuarios en general y en el español en particular. En este trabajo se presenta un análisis de la situación desde un enfoque económico y jurídico, conforme al ordenamiento jurídico español, con la finalidad de poner de manifiesto las especificidades del sector, por una parte; y, por otra, la necesidad de un tratamiento y regulación acorde con dichas especificidades.
