The role of stowage has been as essential as it is controversial in the context of port
systems in general and in Spanish in particular. This paper presents an analysis of the situation
from an economic and legal perspective, under the Spanish legal system, intending to highlight the
specificities of the sector, on the one hand, and, on the other hand, due to the necessity of counting
of those peculiarities’ treatment and regulation. The methodology is based on the main postulates
of economic analysis and the Spanish ports regulatory framework. It is intended to facilitate the
understanding of the multiple factors that come together in this sector, whose conjunction and
simultaneous consideration is necessary to design action and policy proposals. Doing that, it will
favour the productivity, efficiency and profitability of each port as well as of the whole system.
