This article also examines the abolitionist approach undertaken throughout the years, as well as the problems that the reintroduction of this penalty as a legal sanction applicable by the Courts would entail for an abolitionist state like Spain and its current legal system. Regarding the methodology, updated and specialized sources have been used, as well as other monographs and collective works about criminal law that address how this sanction affects the fundamental rights of the person. As a general approach, a remarkable variety of sources and authors has been used, evidence of the doctrinal importance of the subjectEsta investigación se centra en el estudio de la aplicación que ha tenido la pena de muerte en España a lo largo de su historia, junto con la regulación que actualmente existe a nivel interno respecto a esta materia. Se estudia también el camino abolicionista emprendido particularmente por este país. Y finalmente se valoran los problemas que supondría para un Estado totalmente abolicionista como España la reintroducción de esta pena como una sanción jurídicamente aplicable por los Tribunales de acuerdo con el ordenamiento jurídico vigente. Desde el punto de vista metodológico se han utilizado fuentes actualizadas y especializadas en la materia, así como otras monografías y obras colectivas de Derecho Penal para abordar cómo esta sanción afecta a los derechos fundamentales de la persona.
