Summary: This research focuses on the study of the application that death penalty had in Spain throughout history, along with the regulation that currently exists on an internal level regarding this matter. This article also examines the abolitionist approach undertaken throughout the years, as well as the problems that the reintroduction of this penalty as a legal sanction applicable by the Courts would entail for an abolitionist state like Spain and its current legal system. Regarding the methodology, updated and specialized sources have been used, as well as other monographs and collective works about criminal law that address how this sanction affects the fundamental rights of the person. As a general approach, a remarkable variety of sources and authors has been used, evidence of the doctrinal importance of the subject
