The same can be seen as a consumer contract and it is worth noting that the transport activity is characterized as an essential activity mainly for tourism, an element of vital importance for the economic development of the southern european Countries.O Contrato de transporte invoca interesse pela diversidade de elementos implicados na relação jurídica-contratual, desta forma, faz-se necessário, uma análise mais aprofundada de cada um dos seus elementos constitutivos com o claro objetivo de entender as vicissitudes que o afetam. Abordar os elementos constitutivos pessoais e elementos constitutivos formais, oferece-nos ferramentas importantes na construção dogmática da teoria geral desta modalidade contratual.
