The Transport Contract invokes interest in the diversity of elements involved in the
legal - contractual relationship, thus, it is necessary, a more in-depth analysis of each of
its constituent elements with the clear objective of understanding the vicissitudes that
affect it.
Addressing the personal constitutive elements and formal constitutive elements,
offers us important tools in the dogmatic construction of the general theory of this
contractual modality. The same can be seen as a consumer contract and it is worth noting
that the transport activity is characterized as an essential activity mainly for tourism, an
element of vital importance for the economic development of the southern european
