Summary: In this article, the special conditions of inequality that women deprived of liberty in Colombia undergo are analyzed after identifying how gender discrimination is present in the causes of female delinquency. The aforementioned analysis is done in the context of the crisis of the Penitentiary and Prison System of Colombia, of which an unconstitutional state of affairs was declared since the issuance of the judgments T–388 of 2013 and T–762 of 2015 by the Constitutional Court. In accordance with the former, the purpose of this work is to establish the need to implement a differential gender focus that permits the restoration and guarantee of the female prison population’s rights in Colombia in the follow-up process to overcome the country’s penitentiary and prison crisis.
