Soberanía y ambiente en el marco de la Constitución de 1991: Un análisis del uso y efectos del glifosato en la lucha antidrogas en Colombia

The objective of this article is to analyze the relationship between sovereignty and the right to a healthy environment with the war that Colombia is waging against drug trafficking; war that involves the intervention of the United States and one of its most representative companies, Monsanto, producer of glyphosate (now Bayer). The case under study is based on the validity, from the 1991 Charter, of a new national order marked by the sovereign power of the people and their right to decent living conditions, within which the guarantee of health is contemplated. and to a natural habitat free of contamination. For this purpose, results of recent studies demonstrating the damage suffered, both humans and the ecosystem, and its various manifestations are presented, based on the qualitative method, serious alteration conditions were identified in areas of aerial spraying not only in Colombia, Thus, it is concluded that the preservation of a healthy environment rests in the hands of the affected communities and the Constitutional Court.

O caso em estudo parte da vigência, com a Constituição de 1991, de uma nova ordem nacional marcada pelo poder soberano do povo e seu direito a condições de vida dignas, dentro das quais estão contempladas a garantia da saúde e de um habitat natural livre de contaminação. Para tanto, são apresentados resultados de estudos recentes que demonstram os danos sofridos, tanto pelo homem quanto pelo ecossistema, e suas diversas manifestações. Com base no método qualitativo, foram identificadas condições de alteração graves nas áreas de pulverização aérea; conclui-se que a preservação do meio ambiente envolve não apenas atos de governo, mas também a vontade das comunidades afetadasEl objetivo de este artículo es analizar la relación entre soberanía y el derecho a un ambiente sano con la guerra que libra Colombia contra el narcotráfico; guerra que involucra la intervención de los Estados Unidos y una de sus empresas más representativas, Monsanto, productora del glifosato (ahora Bayer). El caso en estudio parte de la vigencia, a partir de la Carta de 1991, de un nuevo orden nacional signado por el poder soberano del pueblo y su derecho a unas condiciones de vida dignas, dentro de las cuales se contempla la garantía a la salud y a un hábitat natural libre de contaminación.
