Summary: The objective of this article is to analyze the relationship between sovereignty and the right to a healthy environment with the war that Colombia is waging against drug trafficking; war that involves the intervention of the United States and one of its most representative companies, Monsanto, producer of glyphosate (now Bayer). The case under study is based on the validity, from the 1991 Charter, of a new national order marked by the sovereign power of the people and their right to decent living conditions, within which the guarantee of health is contemplated. and to a natural habitat free of contamination. For this purpose, results of recent studies demonstrating the damage suffered, both humans and the ecosystem, and its various manifestations are presented, based on the qualitative method, serious alteration conditions were identified in areas of aerial spraying not only in Colombia, Thus, it is concluded that the preservation of a healthy environment rests in the hands of the affected communities and the Constitutional Court.
