Sumario: Trademark law still rests on the principle of territoriality, upon which domestic legislation determines the outcome of a legal controversy pertaining to this field of law, has been attenuated due to the fact that substantive regulation of distinctive signs has been influenced by the harmonizing power of international treaties, mainly Paris Treaty and Trips. Nevertheless, important asymmetries remain among domestic legal systems that result different level of protection to those intangible assets.
