Also, it deals with constitutionalizacion and how legal certainty can be affected by judicial activism and constitutional over interpretation, as well as the risks inherent in them.O presente artigo acadêmico constitui o segundo documento do autor no programa de Doutorado em Ciências Jurídicas da Pontifícia Universidade Javeriana, e apresenta algumas reflexões sobre o impacto que a segurança jurídica pode ter tanto no precedente judicial quanto na constitucionalização do direito. Para tais efeitos, aborda os conceitos de precedente judicial e de jurisprudência, assim como o de sua obrigatoriedade segundo o sistema legal de que se trate. Assim mesmo, se ocupa do tema da constitucionalização do direito e de como os fenômenos de ativismo judicial e a interpretação constitucional podem afetar a segurança jurídica, assim como os riscos que estes apresentam.El presente artículo académico constituye el segundo documento del autor en el programa de Doctorado en Ciencias Jurídicas de la Pontificia Universidad Javeriana, y presenta algunas reflexiones en relación con el impacto que sobre la seguridad jurídica pueden tener tanto el precedente judicial como la constitucionalización del derecho. Para tales efectos, aborda los conceptos de precedente judicial y de jurisprudencia, así como el de su obligatoriedad según el sistema legal de que se trate.
