The author begins by introducing the concept and premises of non-pecuniary damage from tort law theory. Furthermore, the author refl ects on Peruvian labour case law ruling criteria referred to compensation for non-pecuniary damage in the context of arbitrary, uncaused or fraudulent dismissal. At last, the author delves on the need of adhering to precedent criteria for the ruling of non-pecuniary damage casesAl parecer, la predictibilidad jurídica nos elude debido a precedentes judiciales divergentes y heterogéneos. En la jurisprudencia laboral peruana, conceptos como el de daño moral no reciben un tratamiento uniforme, generando incertidumbre en aspectos tales como cuándo se declara o si está sujeto a probanza, entre otros.En este artículo, se busca evidenciar la falta de uniformidad existente en cuanto a los criterios jurisprudenciales empleados al declarar el resarcimiento de daño moral en demandas laborales. Para ello, el autor primero conceptualiza el daño moral y sus presupuestos básicos en el estudio de la Responsabilidad Civil. Posteriormente, comenta jurisprudencia laboral peruana sobre resarcimiento de daño moral ante despidos arbitrario, incausado o fraudulento.
