Summary: The text analyzes the problems that involved the evaluation of the responses of the obligated subjects to the information requests, which could be classified as reserved in the study Metrics of Transparency 2014. The objective of the analysis is to clarify the elements and criteria that should be used to determine when it is appropriate to classify information as reserved. For this, the regulation and the judicial criteria for reserving information are analyzed, and the relationship between the classification of reserved information and the damage test is defined. Subsequently, some of the most relevant responses of the obliged subjects in the matter of reserved information of Metrics of Transparency 2014 are analyzed to determine the parameters that defined a valid argument, and thus classify said information and its relationship with the damage test. The article incorporates a comparative analysis of the proof of damage contemplated in the Federal Law of Transparency and Access to Public Government Information, and in the new General Law of Transparency and Access to Public Information. Finally, the conclusions are presented and an attempt is made to shed light on the challenges faced by the obligated subjects in the face of the application of the damage test.
