Although the attribution of the normative power raises relevant problems, such as the one related to the character of the normative power, the mandatory procedures in the elaboration of the norms and the relations with other norms from the Government and its members, it is also an opportunity to advance in the improvement of the normative quality, given the configuration of the CNMC as an independent body and endowed with high technical capacityEl reciente Real Decreto Ley 1/2019 ha modificado la Ley 3/2013, de creación de la Comisión Nacional de los Mercados y la Competencia, aumentando el ámbito de la potestad normativa de dicho organismo. Con este motivo, la CNMC ha elaborado diversas circulares en el ámbito de la energía, que han dado lugar a una doctrina del Consejo de Estado.
