Summary: The recent Royal Decree-Law 1/2019 has modified Law 3/2013, of creation of the National Commission of Markets and Competition (CNMC), has increased its scope of regulatory power. For this reason, the CNMC has developed several circulars in the field of energy, which have resulted in a doctrine of the State Council. Although the attribution of the normative power raises relevant problems, such as the one related to the character of the normative power, the mandatory procedures in the elaboration of the norms and the relations with other norms from the Government and its members, it is also an opportunity to advance in the improvement of the normative quality, given the configuration of the CNMC as an independent body and endowed with high technical capacity
