Summary: The Judicial Hearings, called Instruction and Judgment, are the way used by the Criminal Justice to upgrade – bring to the present – if the fact that allegedly occurred has violated the law. The narrative is the key of this dynamic, since the parties involved will tell the judge what happened, who in response will replace them and, as State representative, will determine how to solve the lawsuit and judge the consequences for the defendant in question. The purpose of this article was to think the conception of truth present in such hearings, at which time we will support the studies of Michel Foucault (2001), as well as the intrasmissibility experience through contemporary narrative using Walter Benjamin’s thoughts (1996).
