This article arose in the framework of the investigation of a comparative study of labor principles in Latin America and aims to contrast the theoretical and constitutional advances reached by Latin American countries based on the guidelines established by the United Nations and the ILO, with a reality that accounts for the constant and permanent discrimination that affects the rights of hundreds of pregnant women at the time of accessing, staying or withdrawing from the labor market, in a context of vertiginous changes and gradual recognition of the importance of the economy of the care, more in societies committed to the construction of peace and gender equity. In view of the panorama described, an integral protection of motherhood is proposed, assimilating it to a need for survival, worthy of social protection without considering the existence of a work relationship, since the tasks imposed by pregnancy, childbirth, Breastfeeding and upbringing are tasks of collective transcendence whose responsibility involves not only the mother and father, but the family and the entire social conglomerate.

In view of the panorama described, an integral protection of motherhood is proposed, assimilating it to a need for survival, worthy of social protection without considering the existence of a work relationship, since the tasks imposed by pregnancy, childbirth, Breastfeeding and upbringing are tasks of collective transcendence whose responsibility involves not only the mother and father, but the family and the entire social conglomerate.Este artigo surgiu no contexto da investigação de um estudo comparativo dos princípios trabalhistas na América Latina e tem o objetivo de contrastar a nível constitucional teórico e desenvolvimentos legais que atingiu os países latino-americanos das diretrizes estabelecidas a partir da ONU e da OIT, com um realidade que percebe a discriminação constante e permanente que afectem os direitos de centenas de mulheres em gestação no momento do acesso, permanência ou retirar-se do mercado de trabalho, em um contexto de mudanças rápidas e reconhecimento gradual da importância da economia cuidado, mais em sociedades comprometidas com a construção da paz e equidade de gênero. No contexto descrito proteção abrangente da maternidade que assimila a uma necessidade para a sobrevivência, digno de protecção social sem levar em conta a existência de uma ligação de funcionamento surge, uma vez que as tarefas impostas pela gravidez, parto, A amamentação e a educação são tarefas de transcendência coletiva cuja responsabilidade envolve não apenas a mãe e o pai, mas a família e todo o conglomerado social.El presente artículo surgió en el marco de la investigación de un estudio comparado de principios laborales en América Latina y pretende contrastar los avances teóricos a nivel constitucional y legal que alcanzaron los países latinoamericanos a partir de las directrices establecidas desde Naciones Unidas y OIT, con una realidad que da cuenta de la constante y permanente discriminación que afecta los derechos de cientos de mujeres en estado de gestación al momento de acceder, permanecer o retirarse del mercado laboral, en un contexto de vertiginosos cambios y paulatino reconocimiento a la importancia de la economía del cuidado, más en sociedades comprometidas con la construcción de la paz y la equidad de género. Frente al panorama descrito se plantea una protección integral de la maternidad que la asimile a una necesidad de supervivencia, merecedora de la protección social sin consideración a la existencia de un vínculo de trabajo, puesto que la tareas que impone el embarazo, el parto, la lactancia y la crianza son quehaceres de trascendencia colectiva cuya responsabilidad compromete no sólo a la madre y al padre, sino a la familia y a todo el conglomerado social.
