Summary: This article arose in the framework of the investigation of a comparative study of labor principles in Latin America and aims to contrast the theoretical and constitutional advances reached by Latin American countries based on the guidelines established by the United Nations and the ILO, with a reality that accounts for the constant and permanent discrimination that affects the rights of hundreds of pregnant women at the time of accessing, staying or withdrawing from the labor market, in a context of vertiginous changes and gradual recognition of the importance of the economy of the care, more in societies committed to the construction of peace and gender equity. In view of the panorama described, an integral protection of motherhood is proposed, assimilating it to a need for survival, worthy of social protection without considering the existence of a work relationship, since the tasks imposed by pregnancy, childbirth, Breastfeeding and upbringing are tasks of collective transcendence whose responsibility involves not only the mother and father, but the family and the entire social conglomerate.
