Laburpena: This paper explores the case “Erica Borda” resolved by the National Chamber of Labour Appeals on discrimination against women in access to the labour market of public transport in the metropolitan area. Our main thesis argues that the distinction in the rulings of first and second instance is based on a framework issue: while the first decision was based on an individualist paradigm of equality as non-discrimination, the second sentence re-framed the case in a robust notion of equality as non-subjection or non-domination. We will demonstrate that this reframing impacted in three main approaches: in the determination of the normative dispute, in the evaluation of the evidence for the construction of the legal argumentation of the sentences and in the remedial responses.
