In the present study we analyze the most relevant conventional clauses in this matter with special attention to those related to regulating the incidence that the technological transformation of the company has had in the organization of work; to the use of technological instruments (basically e-mail and internet browsing) by workers and their legal representatives; to the business control of work through the new technologies; to the business control of the use of technological devices in the workplace; and the dismissal of worker due to the improper use of technological devices. And all this to conclude that the treatment of this matter by collective bargaining has been partial if it is contrasted with a reality as evident as that derived from the expansion of these technologies in developed societiesLa negociación colectiva laboral ha jugado un papel decisivo en la implementación de las nuevas tecnologías de la información y de la comunicación en el seno de la empresa. En el presente estudio se analizan las cláusulas convencionales más relevantes en esta materia con especial atención a las relativas a regular la incidencia que ha tenido la transformación tecnológica de la empresa en la organización del trabajo; al uso de los instrumentos tecnológicos (básicamente el correo electrónico y la navegación por internet) por parte de los trabajadores y de sus representantes legales; al control empresarial de la prestación laboral mediante las nuevas tecnologías; al control empresarial del uso de los dispositivos tecnológicos en el ámbito laboral; y a la extinción del contrato de trabajo por el uso indebido de dichos dispositivos tecnológicos.
