This article aims at analyzing and mapping the legal apparatus of the guardianship of trans incarcerated women, making the interface between Law and Social Sciences through the analytical category of gender and the activities of the feminist movement. This work aims at a critical analysis of the exclusion of this group, since, initially, they already have their rights disrespected because they do not have their own gender identity. To do so, a bibliographic review was conducted, through mapping and reading articles, books, andthe Brazilian legislation especially. The research was divided into four parts, including the category of gender and its difference between sex, the definition of transsexuality, the fundamental rights approach, and the relation between trans women and the prison system. |
