Laburpena: The Constitutional Court Decision No. 47/2019, of April 8, 2019, considers the remedy of amparo filed by a commercial company when assessing the violation of the right to judicial protection without defenselessness due to the inadequate use of the electronic address enabled as a channel of communication of the first location of the defendant entity. The resolution concludes that one of the joint interpretation of arts. 53.1, 56.1 LRJS and 155.1 and 2, 273.4 LEC; The first citation of the defendant not yet in person, in order to inform him of the content of the complaint and the date of the conciliation and trial, must have been materialized by certified mail with acknowledgment of receipt to the address designated by the plaintiff, independently of the fact that, once she has been appointed, the latter will be obliged to use the telematic or electronic systems existing in the administration of justice.
