One of the criticisms that has been made of the way in which the Civil Procedure is structured has been the exaggerated arreas  that  characterizes it, among other things, determined by the exaggerated use of writing. In this sense, it has been likewise affirmed that these type of delays impinge on a negative way in the aspirations of the parties to obtain a decision positive for their interests, since the effective judicial protection has to comply with the urgency expected of it with regard to the resolution of the conflict, insofar the reasonable duration of the process has to be consistent with the fundamental right of access to justice. Well, to accomplish the desired prompt process procedural reforms have been adopted focused on synchronizing the Civil Procedure with the new reality, and in Colombia this has become evident through the insertion of orality as a principle governor of action by means of a model by hearings with a marked tendency to orality.

Nesse sentido, afirmou-se, por sua vez, que esse tipo de atraso afeta negativamente as aspirações das partes em obter uma decisão favorável aos seus interesses, uma vez que a proteção judicial efetiva deve responder ao imediatismo esperado em relação à resolução do conflito, na medida em que a duração razoável do processo deve ser consistente com o direito fundamental de acesso à justiça. Bem, para alcançar a velocidade processual desejada foram adotadas reformas processuais todas voltadas para a sincronização do processo civil à nova realidade e na Colômbia foi evidenciada através da inserção da oralidade como princípio orientador de ação através de uma modelo para audiências com uma acentuada tendência à oralidade.Una de las críticas que se le ha  formulado  a  la  manera  como está estructurado el proceso civil colombiano ha sido la exagerada morosidad que caracteriza a la actuación, entre otras cosas, determinada por el uso exagerado que, de la escritura, en ellos se hace. En este sentido, se ha afirmado a su vez, que este tipo de demoras incide   de   manera   negativa   en   las   aspiraciones   de   los  sujetos procesales para obtener una decisión favorable a sus intereses, puesto que la tutela judicial efectiva debe responder a la perentoriedad que se espera en relación con la resolución del conflicto, por cuanto que la duración razonable del proceso debe ser consecuente con el derecho fundamental de acceso a la justicia.
