Summary: The right of access to culture has been considered as a fundamental right and even when there are legal instruments that regulate it this right does not have adequate protection, hence the need to implement valid mechanisms that guarantee the use of this right by individuals. In the current context, the system of limits to copyright in favor of libraries, including digital ones, stands as a supposition that guarantees access to culture, by finding the right balance between the purpose of copyright and right of access to culture: the access to scientific, literary and artistic production of society.
