In the so-called “fourth industrial revolution” has been produced proliferation of so-called “atypical
workers” and, in a very significant way, of “false self-employed workers”. This is a phenomenon
that is becoming more acute in relation to the provision of services through digital platforms,
regarding their condition of “workers” which has already been disputed. In this context, it is very
important to analyze the “signs of work”, above all, the determination and updating of classic concepts
such as dependence and alienation, as well as the definition of what is considered working
time and what it is not. This paradigm becomes more complex in this type of digital working, in
which, apart from other specific issues, there are two aspects of working time that are inevitably
linked together. On the one hand, the extreme flexibility of the working day that lies in the fact
that the worker must be “connected”. And, as a consequence of the above, a “new” right to “digital
disconnection”, involving the right to conciliation of personal, family and work life. Following the
resolutions of the Parliament and the European Commission, the “zero hours contract” should be
discarded as a viable alternative. In short, we must address the latest pronouncements of the ECJ
that protect the right to rest on the basis of the interpretation of time availability as working time,
and, therefore, as a sign of work.

Este fenómeno se agudiza en relación con la prestación de servicios a través de plataformas digitales, hasta el punto de que ha sido cuestionada su propia condición de “trabajadores”. En este contexto, es muy importante el análisis de los “indicios de laboralidad”, sobre todo, la determinación y actualización de conceptos clásicos como la dependencia y la ajenidad, respecto de los cuáles será básica la delimitación de qué es tiempo de trabajo y de qué no lo es. Este paradigma se vuelve más complejo en este tipo de trabajos digitalizados, en los que existen dos aspectos del tiempo de trabajo que van inevitablemente unidos entre sí. Por un lado, la flexibilidad extrema de la jornada laboral que radica en el hecho de que el trabajador deba estar “conectado”. Y, como consecuencia de lo anterior, un “nuevo” derecho a la “desconexión digital”, con las implicaciones que acarrea esto sobre el derecho a la conciliación de la vida personal, familiar y laboral. Siguiendo las resoluciones del Parlamento y de la Comisión Europea, ha de descartarse el “contrato de cero horas” como alternativa viable.
