This article analyzes this new regime and provides several criteria or guidelines for its complementation by our legislation, complementation that should translate into a future specific law for the protection of health data. One of the areas in need of revision and adaptation to the regulation, complementing the legal regime that establishes, is the informed consent in biomedical research.El Reglamento General de Protección de Datos es de plena aplicación a partir de mayo de 2018, lo que exige la adaptación de nuestra legislación de protección de datos de salud a las disposiciones del Reglamento. Incorpora novedades que comportan nuevas obligaciones para los responsables y encargados del tratamiento de datos de salud. En este trabajo se analiza ese nuevo régimen y se ofrecen criterios o pautas para su complementación por nuestra legislación, complementación que debería plasmarse en una futura ley específica de protección de datos de salud.
