The General Data Protection Regulation will be
fully applicable from May 2018 and on wards, which
requires the adaptation of our health data protection
legislation to the provisions of the regulation. It incorporates
new features that involve new obligations
for those responsible and in charge of the processing
of health data. This article analyzes this new regime
and provides several criteria or guidelines for its
complementation by our legislation, complementation
that should translate into a future specific law for
the protection of health data. One of the areas in need
of revision and adaptation to the regulation, complementing
the legal regime that establishes, is the informed
consent in biomedical research. |
