Summary: After the European reform in 2014, the approval of the Spanish Public Procurement Act 9/2017 confirms the tendency observed throughout the last years towards the instrumentalization of public contracts as a convenient tool for the implementation of public policies. In the present paper we analyse the fundamental theoretical aspects that legitimate this directive function of public contracts. Finally, we evaluate the opportunities for implementation that the LCSP offers and the possible limits that these kind of practises face.
