It was possible to highlight some legal gapsand obstacles of institutional origin, which make it difficult for the FamilyOmbudsman to exercise his or her role in the adoption process, due to thefact that they force their discretion and delay the term in their administrativeactions.El interés de este artículo es realizar a través de un estudio bibliográfico en el marco constitucional, legal, jurisprudencial y doctrinario la actuación del Defensor de Familia como responsable del proceso de adopción en Colombia. En este estudio se encontró que la Constitución Política, las Leyes 1098 de 2006 y 1878 de 2018, y otros documentos normativos nacionales e internacionales de obligatorio cumplimiento en el territorio nacional regulan lo relativo a éste proceso.
