Summary: STC 151/2017 has declared unconstitutional the requirement that proposals for censorship motions at the local level be endorsed by an absolute majority, increased by a number of councilors equivalent to those of non-attached councilors who proposed the motion. But the argument is based on proportionality; and it´s not correct because the motion of censorship enters the nucleus of the representative function, with respect to which the legislator can specify its intrinsic limits but not establish extrinsic limitations outside objective criteria. Th ese limitations could never be justifi ed in a pretended proportionality. Besides, there are other regulatoryalternatives.
