The fashion industry is of great importance for the Brazilian economy market, involves the movement of goods resulting from an intellectual effort and peculiar creative. Fashion comes from innovation, distinction of styles that end up forming tendencies that define seasons. For this reason, it is of utmost importance that developed mechanisms for the protection of fashion creations by copyright, in order to ensure innovation. This work will seek to work with the possibilities of Brazilian law under the copyright to guarantee such protection, fighting point of view that piracy can be beneficial to the market. Therefore, it will analyze the experience of Comparative Law, both in the Copyright system as in the Droit d'Auteur and its convergence with the evolution of jurisprudence and doctrine Brazilian towards the protection of fashion creations by copyright. |
